Is Test and Tag Actually the Law in Australia?

For most workplaces, effectively yes — even though the law doesn’t spell out “you must test and tag every item on this exact date.” Work health and safety law puts a duty of care on you to make sure electrical equipment is safe and maintained, and testing and tagging to AS/NZS 3760 is the recognised way to meet that duty. So while it’s technically the outcome (safe equipment) that’s required, test and tag is how you get there and prove it.

Let’s clear up the confusion.

The law is about safety, not a schedule

Under WHS law, if you run a business you have to provide a safe workplace — and that includes safe electrical equipment. The law doesn’t hand you a rigid timetable for every kettle and power lead. Instead, it holds you responsible for the result. AS/NZS 3760 is the benchmark everyone uses to show they’ve managed that responsibility properly.

So the honest answer to “is it the law?” is: keeping your gear safe is the law, and test and tag is the accepted method of doing it and documenting it.

Where it’s closer to a hard requirement

Some situations tighten this right up:

  • Construction and demolition sites are governed by additional rules (AS/NZS 3012) that require regular testing — every 3 months.
  • Certain industries and contracts (mining, government, many commercial leases and insurers) specifically require current test-and-tag records before you can work or trade.

In those cases, “recommended” becomes “no records, no entry.”

What happens if you ignore it

Safety inspectors don’t accept “I didn’t know” as a defence. If your equipment isn’t safe and you can’t show it’s been maintained, you’re exposed to improvement notices and fines — and you’re in a far worse position if there’s already been an incident. If you’ve got employees or the public using your electrical equipment, treat test and tag as required. It’s cheap, it’s quick, and it takes a serious liability off your plate — and who’s actually allowed to do it matters too, see what a “competent person” means.
